Information on the use of personal data
Article 13 of Decree-law June 30, 2003, n. 196 “Data protection directive”

Dear Client,

We wish to inform you that the “Data protection directive” Legislative Decree n. 196/2003, Article 13 requires that the party concerned be informed regarding the fundamental elements of processing, specifying to comma 1, letter a), f). According to said directive, such use shall be based upon the principles of decency, lawfulness and transparency and of protection of your confidentiality. We inform you, moreover, that the personnel which treats your data is entrusted with the execution of the single operations with written instructions and may have access to the information which is strictly necessary to the execution of the assigned tasks.

Purpose of use
The data you have provided to Filati Biagioli Modesto, or in any case available at our structure, shall be object of use for the fulfillment of the following services: administration, accounting, contractual, web marketing strategies (periodical newsletter), etc…

Conditions of use
The data provided to Filati Biagioli Modesto shall be object of use in written form and/or paper, magnetic, electronic or data transmission storage mediums, with instruments which are suitable to guaranteeing the confidentiality and safety of the same and their use may also take place through automated instruments suited to memorizing, managing and transmitting the selfsame data.

Mandatory data elements
We wish to inform you that their conferment is obligatory as it is requested due to legal and contractual obligations, therefore, full or partial refusal to provide them, would imply the inability on the undersigned’s part to initiate a contractual relationship.

Excluding communications and distributions carried out pursuant to law and contract mandates, the data given to the undersigned shall be utilized solely for the carrying out of internal administration and may be communicated, for contractual obligation or in order to better manage the respective rights relative to the single business relation:

3.    to companies/professionals who provide legal and credit collection services;

Moreover, we wish to communicate that the following types of entities may be made aware of the data:

Members of statutory administrative, control and management bodies,
Registry offices and internal secreteriats;
Persons in charge of electronic data processing;
Persons in charge of maintenance and repair;
Accounting and invoicing personnel;

Your data shall not be subject to distribution.

Rights of the party in question
You may contact the data controller to exercise your rights are stipulated in Article 7 of Legislative Decree n. 196/2003 which text is for your convenience hereinafter transcribed:

Legislative Decree n. 196/2003 Article 7 – Right of Access to Personal Data and Other Rights

1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
2. A data subject shall have the right to be informed
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part,
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
